O direito que se analisa, com plúrimas projeções, apresenta um campo de proteção amplo, em comparação com diplomas fundamentais de outros países, incluindo uma vertente civilística. A ultrapassagem dos limites legais da esfera do direito à reserva da intimidade da vida privada stricto e lato sensu, nomeadamente colocada pelo problema do enquadramento jurídico-constitucional da realização das escutas telefônicas - o “registro técnico das palavras num suporte que torne possível a sua ulterior audição”, na definição de Manuel da Costa Andrade - em processo penal configura uma das dificuldades judiciárias mais prementes que urge procurar solucionar. A legislação portuguesa é das mais ortodoxas na configuração da salvaguarda do direito à reserva da intimidade da vida privada, sendo objeto de debate a consequência da violação dos ditames processuais - proibição do meio de obtenção de prova vs. nulidade processual - e o bem jurídico protegido pelas incriminações subjacentes àquela. ABSTRACT The Portuguese Republic, in its legal system, protects in its Article 26th, n. 1 and among "other personal rights”, the right to privacy in the private life in a diligent contour. The right under analysis has multiple projections, features a large protective field compared to fundamental diplomas from other countries, including a civilistic shed. Exceeding the legal limits of the sphere of the right to privacy in the private life stricto and lato sensu, namely placed by the problem of legal/constitutional framework of carrying out the wiretapping - the "technical record of the words in a way that makes possible its further hearing", under the definition by Manuel da Costa Andrade - in criminal proceedings sets up one of the most pressing judicial difficulties, urgently in need of resolution.
