A condensação do processo: do questionário aos temas da prova

Abstract

A presente dissertação prende-se com a fase intermédia do processo de saneamento e condensação. Pretende estudar as figuras que marcaram a condensação do processo civil ao longo do século XX no ordenamento jurídico português (o questionário e a base instrutória), para depois se debruçar sobre a análise dos temas da prova, introduzidos em 2013 pelo novo Código de Processo Civil. Trata-se de uma tarefa a levar a cabo pelo juiz gestor, no intuito de limitar o litígio às questões essenciais e orientar a produção da prova. Por fim, procura-se apurar a influência que os temas da prova poderão exercer sobre o princípio do dispositivo, procurando flexibilizá-lo.

This dissertation relates to the intermediate stage of winding up and shortening procedures. The aim is to study the techniques that have influenced the shortening of civil proceedings throughout the twentieth century within the Portuguese legal system (the judge’s opening remarks and finding of facts), and then to analyze the items of evidence introduced in 2013 by the new Civil Procedure Code. This task is to be undertaken by the presiding judge, in order to limit the action to the key issues and to guide the production of evidence. Finally, we seek to determine the influence that the items of evidence may have on the duty of the parties to present evidence, and to make it more flexible.
