Abstract: A presente dissertação toma como ponto de partida a realidade subjacente à existência de comportamentos alienantes no contexto decorrente da ruptura entre progenitores, independentemente da relação vivenciada por estes. Depois das obrigatórias considerações prévias face às responsabilidades parentais analisamos o fenómeno da alienação parental, que definimos de acordo com a situação paradigmática em que depois do desvínculo e perante uma conjuntura em que o grau de conflitualidade é extremo, um dos progenitores prejudica grave e continuamente a relação existente entre a criança e o outro progenitor, através de diversos mecanismos, ambicionando-se uma relação de exclusividade com a criança. Tudo isto poderá levar, em casos-limite a que o menor venha a recusar, sem justificação, o contacto com o progenitor, transformando a criança numa verdadeira “arma de arremesso” de uma guerra à qual esta não pertence. Tudo isto deixa marcas inevitáveis no desenvolvimento da criança, principal vítima e no progenitor que se vê afastado sem motivo aparente do filho. Partindo dos contributos estrangeiros, compreendemos que já existem no ordenamento jurídico português instrumentos suficientes para minimizar as consequências e até evitar a existência de comportamentos alienantes. Como meios de cariz mais pedagógico, apresentamos a mediação familiar, a audição da criança relacionando-a com a jurisdição voluntária subjacente, a cooperação das equipas multidisciplinares junto dos tribunais que lidam com matérias ligadas à família, o estabelecimento rápido de um regime provisório e o papel fulcral dos advogados. A juntar a estes mecanismos, observamos ainda outros de teor mais repressivo, porém necessários face à gravidade em causa. Falamos da alteração do regime existente, da aplicabilidade da LPCJP e ainda da tutela criminal do artigo 249.º/1/c do CP. ABSTRACT This dissertation has as a starting point the reality underlying the existence of alienating behaviours in the context which results from the rupture between parents, independently from the relationship experienced by them. After the required previous considerations about parental responsibilities, we analyse the phenomenon of parental alienation defined according to the paradigmatic situation in which after the separation and facing a scenario of extreme conflict, one of the parents seriously and steadily harms the relationship between the child and the other parent, in different ways, aiming at an exclusive relationship with the child. In extreme cases, this entire situation may lead the minor to refuse the contact with the other parent, without any reason, thus the child being transformed in a real weapon in a conflict he/she does not belong to. All of this will end up having its inevitable consequences in the development of the child, who is the main victim and also in the other parent, who sees himself/herself drawn apart from his/her child for no apparent reason. Based on foreign contributions, we understand that there are already enough tools in the Portuguese legal system to minimize the consequences and even avoid the existence of alienating behaviours. As more pedagogical methods, we point out the family mediation, the hearing of the child relating it with the implied voluntary jurisdiction, the cooperation of the multidisciplinary teams at the courts dealing with family issues, the quick setting of a transitional system and the fundamental role of the lawyers. Besides these, we also pay attention to other methods which are more repressive but needed due to the seriousness of the situation. We mean the change of the legal system, of the applicability of the LPCJP and also of the criminal protection of the article 249.º/1/c CP
