dc.description.abstractConfrontados com a sociedade em constante mudança, é cada vez mais difícil para os contraentes preverem os riscos que possam incidir sobre eles após a constituição do negócio. Por vezes, certas ocorrências inesperáveis são capazes de perturbar a base do negócio ou até conduzir uma parte à ruína com a vinculação contratual rígida. O regime da alteração superveniente das circunstâncias foi, assim, desenvolvido no sentido de atenuar o princípio pacta sunt servanda. Por outro lado, a fronteira entre a impossibilidade absoluta e a impossibilidade relativa tem-se esbatido devido aos avanços científicos e tecnológicos, registou-se, portanto, uma tentativa de alargar o conceito de impossibilidade por forma a acolher os casos em que a prestação é teoricamente ainda realizável, mas a sua exigência não deve ser esperada à luz da consciência jurídica. Este estudo pretende abordar a tendência jurídica moderna respeitante a possibilitar a modificação ou a resolução do contrato em virtude da alteração do ambiente circunstancial e viabilizar a exoneração do cumprimento pelo alargamento da impossibilidade, através da análise das respetivas revisões legislativas, sobretudo, no direito civil alemão, visando versar a eventual introdução da impossibilidade prática e da impossibilidade moral no ordenamento jurídico português e a relação entre elas com a alteração superveniente das circunstâncias, ousando encontrar uma via de solução adequada. Abstract Confronted with the ever-changing society, it is each time more difficult for the contracting parties to preview the risks that can happen to them after the establishment of the transaction. Frequently, certain unexpected occurrences are able to disturb the foundation of the contract or even drive a party to a ruinous situation with the rigid contractual bond. The regime of the change of circumstances has been consequently developed to mitigate the principle pacta sunt servanda. On the other hand, the border between the absolute impossibility and the relative impossibility has dimmed due to the scientific and technological advances, therefore there has been attempt to extend the concept of impossibility in order to accommodate the cases where the performance is still theoretically achievable, but whose requirement should not be expected according to the legal consciousness. This study aims to discuss the modern legal trends in allowing the modification or termination of the contract due to the change of circumstances and enabling the exoneration of performance with the enlargement of the impossibility, by analyzing the respective legislative revisions, mainly in German civil law, with the objective to explore the possible introduction of the practical impossibility and moral impossibility in the Portuguese legal system and the relationship between them and the change of circumstances, attempting to find an adequate solution for the problem.por
