Abstract: Esta dissertação tem como objectivo abordar o tema “bases de dados de perfis de ADN”. Depois de uma breve análise histórica, constata-se uma vincada e indiscutível importância desta forma de armazenamento de perfis de ADN obtidos a partir da análise de amostras, tanto a nível de identificação civíl como, especialmente, a nível da Genética Forense, na investigação criminal. Esta organização de dados é feita exclusivamente com base em perfis de ADN obtidos em marcadores que não permitam captar qualquer informação de saúde ou informação hereditária. Após um debate responsável e consciente dos principais problemas ético-legais inerentes à criação desta ferramenta, problemas esses limitantes para um normal fucionamento, criam-se as condições óptimas para a sua implementação e regulamentação rigorosa. Ao analisar as principais bases já existentes na Europa, constata-se em primeira mão uma heterogeneidade de finalidades, critérios de inclusão e exclusão de dados, entre outros e, consequentemente, de regulamentos destas. Com efeito, conclui-se que muito há a aperfeiçoar e homogeneizar, por forma a alcançar os principais objectivos e potenciar as suas aplicações, permitindo uma identificação rápida de infracções repetitivas, facilitando uma interligação entre diferentes infracções, possibilitando a identificação de suspeitos e a exclusão identificativa de inocentes, facultando, por vezes, uma dissuasão de novas infracções e, por outro lado, na vertente civil atingindo a identificação de desaparecidos e alcançando a colaboração internacional em processos de identificação. Em Portugal existe uma base desde 2008, regulada pela Lei n.º5/2008. Esta assenta no respeito pelo princípio da dignidade da pessoa humana, pelos direitos fundamentais consagrados na Constituição da República Portuguesa e pelos princípios do processo penal português e da protecção de dados pessoais. É uma das bases mais cautelosas da Europa e tem critérios rigoros de segurança. Tem duas finalidades distintas, a de identificação civil e a de investigação criminal e pertence ao Instituto Nacional de Medicina Legal. É contudo uma base com poucos dados que tem que ser divulgada e incrementada para que a sua eficiência seja ainda mais profícua. Importa analisar e perceber quais os motivos para que a base não possua mais dados e importa auscultar se, efectivamente, o poder judicial está suficientemente senssibilizado para o desenvolvimento desta base.
The main objective of this research work is the study of the DNA profile databases. After presenting a brief historic analysis, it’s possible to notice the pronounced value and significance of this way of DNA storage, obtained from samples examinations in civil identification but particularly in criminal investigation. This data organization is made exclusively based on DNA profiles obtained from markers that won’t allow the achievement of any health or hereditary information. A responsible and serious discussion about the legal ethic problems is made before ensuring that all optimal conditions to this databases implementation and regulation are created. Analyzing all the main European databases that already exist, reveals an heterogeneity of purposes, criteria for inclusion and exclusion of data, among others, and consequently these regulations. Indeed, it appears that there’s much to improve and standardize in order to achieve the main objectives and enhance their applications, enabling rapid identification of repetitive violations, facilitating an interface between various offenses, allowing the identification of suspects and identifying exclusion of innocent people by providing sometimes a deterrent to further infringements and, moreover, in reaching the civilian identification of missing persons and achieving international cooperation in identification processes. In Portugal there is a database since 2008, regulated by Law No. 5 / 2008. This is based on respect for human dignity, fundamental rights enshrined in the Portuguese Constitution and the principles of Portuguese criminal procedure and the protection of personal data. It is one of Europe's most conservative databases and has strict standards of security. It has two distinct purposes, the civil identification and criminal investigation and belongs to the National Institute of Forensic Medicine. However, it’s a database with only a few basic data that must be disclosed and increased their efficiency to be even more fruitful. It should analyze and understand the motives for which the base has no more data and perceive if, indeed, the judiciary is sufficiently sensitized to the development of this database.
