dc.description.abstractO presente texto problematiza o discurso dos Direitos Humanos (DH) enquanto estratégia contra-hegemónica trans-escalar. Partindo do reconhecimento da natureza paradoxal dos DH, inicia-se uma breve análise da sua discursividade enquanto ferramenta atual de manipulação ao serviço da ideologia neoliberal, assim como das principais subversões e perigos subsequentes. Posteriormente, sem descurar a importância das lutas contra-hegemónicas exteriores a esta gramática da dignidade humana, procura-se refletir sobre as potencialidades e limitações do discurso dos DH enquanto potencial ferramenta impulsionadora de um legalismo cosmopolita subalterno. Na última parte apresentam-se estratégias de natureza política e jurídica, descritas em diferentes estudos de caso, que podem potenciar lutas contra-hegemónicas dos movimentos sociais - na escala local, nacional e internacional, no terreno legal hegemónico. Argumenta-se que os processos de reapropriação do discurso dos DH, enquanto dispositivo contra-hegemónico trans-escalar, envolvem a construção de uma intertextualidade composta por diferentes experiências, emoções e diferentes géneros discursivos.por
dc.description.abstractThe present paper problematizes Human Rights (HR) discursivity as a counter-hegemonic transcalar strategy. Acknowledging the paradoxical nature of HR, this modest reflection starts with a brief analysis about this discursivity as an instrument of manipulation used by the neoliberal ideology, and consequently its adverse and dangerous effects. Underlying the importance of other counter-hegemonic struggles beyond this single grammar of human dignity,the text will then focus on the potentialities and limits of Human Rights as a potential instrument of a cosmopolitan subaltern legalism. On the last section, strategies of juridical and political nature are described, in order to empower counter-hegemonic struggles of social movements – on a local, national, and international scales – on the hegemonic legal arena. It is argued that the construction of an intertextuality based on multiple and different experiences, emotions, and speech-genres, is required in order to enable reappropriation processes of the HR discursivity by counter-hegemonic struggles.por
