Resumo: O Estado, modelo de organização das comunidades humanas na modernidade, tem uma génese cultural na medida em que foi erguido sobre um substracto humano e territorial culturalmente delimitado: a nação. Apesar do vocábulo nação ser um dos conceitos dotados de maior grau de indeterminabilidade em toda a enciclopédia jurídica, a doutrina reconhece-lhe de modo pacífico as características da existência de uma matriz cultural típica e da homogeneidade das pessoas que a integram. O conceito de nação desenvolveu-se segundo duas matrizes ideológicas diversas, étnico-cultural assente no ideal teutónico da pureza raça, e electivo-cultural, fundada sobre os pressupostos francófonos do legado de memórias e do desejo de união da comunidade. O Estado como forma de organização política surgiu com a Paz de Westefália e foi erguido, em regra, como estrutura jurídica de cada uma das nações europeias, de quem herdou o legado cultural, mas apesar do carácter promissor desta genética comum nem sempre o poder político manteve uma pressuposta relação de cumplicidade com o fenómeno cultural durante a modernidade. A cultura, antónimo de natura e portanto apanágio do espírito e do engenho humano, é um conceito biunívoco que abrange a cultura em sentido antropológico ou civilização, identificadora do modo dos povos viverem e de se relacionarem, e a cultura em sentido humanista ou cultura, que consiste no conjunto de actividades humanas referentes ao domínio do conhecimento, nomeadamente arte e ciência. A cultura, como qualquer fenómeno social, é relevante para o ordenamento jurídico de uma comunidade humana. A modernidade revelou, no entanto, uma multiplicidade de variáveis no relacionamento entre Estado, Direito e cultura, desde a instrumentalização da cultura pelo Estado absoluto, à reivindicação liberal da autonomia da cultura como prelúdio da liberdade humana, ao anátema da cultura nos primórdios do Estado social, apesar do proclamado desiderato de valorização do económico do social e do cultural, até à reabilitação da cultura numa fase de aperfeiçoamento do Estado que mantém uma vocação social, embora haja mitigado os procedimentos de realização de prestações. Se a Teoria do Estado nunca deixou de acompanhar numa perspectiva analítica a dinâmica das relações entre poder político e cultura, a Ciência do Direito também não poderia ignorar este fenómeno social e, mesmo sem empregar o termo cultura, as Constituições foram progressivamente regulando matérias de âmbito cultural, desde logo o ensino. O crescimento quantitativo e qualitativo das matérias culturais nos textos constitucionais motivou a formulação do conceito doutrinário de Constituição cultural, complementar das sedimentadas Constituições política, económica e social, permitindo assim ao Direito Constitucional regular na plenitude os fenómenos sociais pela integração no seu quadro normativo das relações estabelecidas no contexto de qualquer dos quatro sub-sistemas sociais interactivos, assim como nos respectivos intercâmbios. A Constituição cultural portuguesa que, é reconhecida pela comunidade jurídica além-fronteiras como impressionante na dedicação que presta às questões culturais, está organizada numa dinâmica pentagonal que compreende as perspectivas de liberdade, solidariedade, dever, acervo e tarefa. Concretizando este modelo, é possível delimitar a Constituição cultural portuguesa nos seguintes termos. A cultura (i) como liberdade incorpora as liberdades de criação intelectual, nomeadamente artística e científica, que compreendem a invenção, produção e divulgação da obra, abrangendo ainda a protecção legal dos direitos de autor, a liberdade de transmissão (ensinar) e a correlativa liberdade de assimilação (aprender) culturais, a liberdade de criação de escolas particulares e cooperativas, a autonomia universitária e ainda a liberdade de participação democrática no ensino. A cultura (ii) como solidariedade compreende o direito de acesso à criação cultural, nomeadamente artística e científica, o direito à educação, e o direito à fruição cultural. A cultura (iii) como dever comporta o direito-dever dos pais de educação dos filhos, o dever de todos preservarem, defenderem e valorizarem o património natural e cultural e o dever de algumas associações e fundações colaborarem com as entidades públicas na prossecução das suas tarefas culturais. A cultura (iv) como acervo, compreende os símbolos nacionais e o património natural e cultural do Estado Português. A cultura (v) como tarefa das entidades públicas abrange uma panóplia de actividades de âmbito cultural cuja prossecução está a cargo do Estado e de outras entidades públicas visando o escopo da realização da democracia económica, social e cultural na sua plenitude. A análise da Constituição cultural portuguesa permite um conjunto de princípios modeladores das normas que a incorporam e que contribuem para identificar uma ideologia que lhe está suprajacente, plasmada nos princípios da dignidade humana, da liberdade, da democracia, da solidariedade e da neutralidade.
The State, being the model of organization of human communities in modernity, has its cultural genesis in the fact that was built on the essence its people and territorial are culturally bounded: the nation. Although the word nation is one of the concepts that provides a greater degree of indeterminacy in any legal encyclopedia, authors recognize in a peacefully way, singularities features of the existence of a cultural matrix and homogeneity typical of the people that are part of it. The concept of the nation has been developed accordingly to two different ideologies, one based on ethno-cultural ideal of the pure Teutonic race, and, the other one, based on the elective-cultural, founded on assumptions of the Francophone legacy of memories and the desire to unite the community. The State as a form of political organization that arose with the Westefália Peace and was established as a rule, as the legal structure of each of the European nations, from whom has inherited the cultural legacy, but despite the promising nature of this common genetic not always the political power has maintained the expected relationship of complicity with the cultural phenomenon during modernity. The culture, opposite of nature and therefore the attribute of the spirit and of the human ability, is a two-way concept that includes encompasses the culture in the anthropological sense or civilization, identifying the way people live and interact with themselves, the culture in the humanistic sense or culture, that consistes in the set of human activities related to the field of knowledge, namelly art and science. The culture, like any social phenomenon, is relevant to the legal system of a human community. Modernity has revealed, however, a multiple of different kinds of relationships between State, Law and culture, from the manipulation of culture by the absolute State, the claim of liberal autonomy of culture as a prelude to human freedom, anathema to the culture at the beginning of the Welfare State, despite the proclaimed wish for the appreciation of the economic of the social and cultural values, to the rehabilitation of the culture in the improvement phase of the state that up keeps a social vocation, although there is mitigated procedures for the provision of services. Once the State theory has never ceased to keep an analytical perspective the dynamics of the relationship between political culture and the Science of Law, could not ignore this social phenomenon and, even without use of the word culture, the Constitutions were progressively regulating issues of scope cultural, such the education. The growth of quantitative and qualitativ of cultural issues in constitutional texts led to the formulation of doctrinal concept of cultural Constitution, supplement of sedimented political, economic and social Constitutions, allowing the Constitutional Law to fully regulat social phenomena by integrating in its normative relations established in the context of any of the four social interactive sub-systems, as well as the respective exchanges. The cultural portuguese Constitution that is recognized by the legal community across borders as impressive dedication in providing cultural issues, is organized in a dynamic pentagonal comprising the prospects of freedom, solidarity, duty, and task. Materializing this model it is possible to identify the cultural portuguese Constitution as a whole. The culture as (i) freedoms incorporates freedom of intellectual creation, including artistic and scientific comprising the invention, production and dissemination of the work includes also the legal protection of copyright, freedom of transmission (teaching), the correlative freedom assimilation (learning), freedom to create private and cooperative schools, university autonomy and also the freedom to participate democratic in the education. The culture (ii) as solidarity includes the right of access to cultural creation, including artistic and scientific, the right to education and the right to cultural enjoyment. The culture (iii) a duty includes the right and duty of parents to children's education, the duty of everyone to preserve, defend and enhance the natural and cultural heritage and the duty of some associations and foundations collaborate with the authorities in pursuit of their tasks cultural. The culture (iv) as a collection, includes the national symbols and the natural and cultural heritage of the Portuguese State. Culture (v) the task of public authorities covers a range of cultural activities under whose pursuit is the responsibility of the State and other public bodies aiming the scope of the realization of economic democracy, social and cultural in its fullness. The analysis of the portuguese cultural Constitution allows a set of principles that ruegulate the rules that incorporate and contribute to identify an ideology that is overlying and is molded on the principles of human dignity, freedom, democracy, solidarity and neutrality.
